Regulations for the Handling of Donations

Article 1 Purpose

The purpose of these regulations is to stipulate necessary matters with regard to donations received by the Hiroshima Peace Creation Fund (hereinafter “the foundation”).

Article 2 Definitions

  1. As used in these regulations, the following terms shall have the following meanings:
    a.Ordinary donations: donations received from members of the foundation or the general public, including members of the foundation, through regular fund-raising activities
    b.Specified donations: donations received from members of the foundation or the general public, including members of the foundation, through fund-raising activities conducted over a limited period of time for a specific purpose
    c.Special donations: donations other than those set forth in the preceding paragraphs received from individuals or groups
  2. As used in these regulations, “donations” includes money as well as property rights other than money.

Article 3 Soliciting ordinary donations

  1. The foundation may solicit ordinary donations on a regular basis.
  2. Ordinary donations shall be solicited on the condition that no less than 50 percent of the total amount received shall be used for the charitable purposes set forth in Article 4 of the Articles of Incorporation.

Article 4 Soliciting specified donations

  1. When soliciting specified donations, the total amount to be solicited, the length of the solicitation period, those from whom donations will be solicited, the reason(s) for the solicitation, the use of the funds as stipulated in the following paragraph and any other necessary matters shall be specified in writing, and this document (hereinafter “fund-raising prospectus”) shall be submitted to the board of directors for their approval.
  2. After deducting reasonable solicitation costs, all or part of the total amount of specified donations shall be stipulated for use for the charitable purposes set forth in Article 4 of the Articles of Incorporation. In this case, reasonable solicitation costs shall not exceed 30 percent of the total amount solicited.

Article 5 Issuance of fund-raising prospectus

When soliciting specified donations, a fund-raising prospectus shall be issued to prospective donors in advance.

Article 6 Sending of receipts

  1. When ordinary or specified donations are received, a thank-you note, receipt, and fund-raising prospectus as described in Article 4, Paragraph 1 shall be sent to the donor without delay.
  2. The receipt referred to in the previous paragraph shall state that the donation pertains to the charitable purposes of the foundation and shall include the amount of the donation and the date it was received.

Article 7 Fund-raising reports

  1. Immediately after the solicitation period for specified donations, the foundation shall issue a report to donors stating the total amount of donations received, how the funds are to be used and other necessary items. This information may be disclosed via the foundation’s Web site instead.
  2. After specified donations have been spent, the foundation shall issue to donors a report including the settlement of accounts pertaining to the donations and the outcome of the expenditures. This information may be disclosed via the foundation’s Web site instead.

Article 8 Special donations

  1. The foundation may receive special donations from individuals or groups.
  2. With regard to donations referred to in the previous paragraph, when the donor stipulates how the funds shall be used or managed, the approval of the board of directors shall be sought before accepting the donation.
  3. Donations shall be refused in the event of any of the following or the risk thereof:
a.Individuals or groups other than the central government, local governments or those stipulated in Article 5, Paragraph 17 of the Act on Authorization of Public Interest Incorporated Associations and Public Interest Incorporated Foundations will receive special benefits as a result of such a donation
b.The donor will receive an unfair reduction in taxes as a result of having made the donation
c.Acceptance of the donation will result in a significant financial burden to the foundation
d.Aside from the three cases outlined above, it is determined that acceptance of the donation will have an adverse effect on the foundation’s execution of its duties or that it is inappropriate under normal social conventions

Article 9 Disclosure of information

With regard to donations received by the foundation, the items specified in Article 22, Paragraph 5 of the Act on Authorization of Public Interest Incorporated Associations and Public Interest Incorporated Foundations shall be kept in the office and made available for inspection.

Article 10 Protection of personal information

Personal information related to donors shall be managed with the utmost care in accordance with separate Regulations for the Protection of Personal Information.

Article 11 Revision or abolition

The revision or abolition of these regulations shall be carried out by a resolution of the board of directors.

(Supplementary regulations)

  1. Matters necessary for the implementation of these regulations shall be prescribed separately.
  2. These regulations shall take effect August 6, 2012.
